The undersigned (hereafter called the “APPLICANT”), hereby applies for membership in, and agrees to purchase electric energy from Yellowstone Valley Electric Cooperative, Inc., (hereafter called “YVEC”), upon the following terms and conditions:

1. A security deposit may be required.

2. Except as otherwise set forth in YVEC’s policies or otherwise allowed by law, the APPLICANT will, when electric energy becomes available, purchase from YVEC all electric energy used on the APPLICANT’S premises, and will pay such minimum amount, regardless of the amount of electric energy consumed, as shall be fixed by the Board of Trustees from time to time.

3. The APPLICANT will comply with and be bound by the provisions for the Articles of Incorporation and Amended By-Laws of YVEC, and such rate policies, schedules, service policies, regulations and billing procedures as may from time to time be adopted by YVEC.

4. Production or use of electric energy on members premises, regardless of the source thereof, by means of facilities which are interconnected with YVEC’s facilities shall be subject to appropriate rules and regulations as shall be adopted from time to time by YVEC.

5. APPLICANT’S membership at YVEC shall become effective upon electric service being made available at APPLICANT’S designated property by YVEC or upon approval of APPLICANT’S membership by YVEC’s Board of Trustees, whichever occurs first.

6. The APPLICANT, through this application and agreement, and in consideration for YVEC furnishing electric service, hereby grants and conveys all necessary and convenient rights-of-way, easements, and rights of ingress and egress, on, under, over, and across APPLICANT’s property to YVEC for the purposes of installing, furnishing and maintaining electric service and facilities, which shall include the right to clear right-of-way, either physically or chemically, and which shall include the right of YVEC to extend said facilities, structures and lines to property and members beyond APPLICANT’S property, without charge whatsoever.

7. In the event the APPLICANT defaults on any charges for electric service, construction, extension, or any other accounts, YVEC shall have the right to collect the entire balance due including delinquent fees per month on unpaid balances and YVEC may elect any remedy at law as well as the right to disconnect its electric facilities and lines; in the event of an action at law to enforce collection, the APPLICANT agrees to pay YVEC’s attorney fees and court costs.

8. YVEC shall have the right to apply any or all APPLICANT’S unretired Patronage Capital toward the payment of the APPLICANT’S unpaid billing balance(s).

9. APPLICANT will notify the Cooperative immediately if any of the information set forth below is incorrect, is changed, or otherwise becomes obsolete or misleading. Failure of the APPLICANT to inform or update the Cooperative with a current address may result in the APPLICANT forfeiting unclaimed Patronage Capital due to an inability of the Cooperative to contact APPLICANT.
